1. Acceptance of Terms

By using any services provided by Flowpoint7 Ltd ("Flowpoint7", "we", "us", "our"), you agree to these Terms and Conditions. These terms apply to all clients across Canada and any other territories we operate in. Our services are intended for adults aged 18 and over only.

2. Our Services

Flowpoint7 provides done-for-you digital marketing services for Canadian trade businesses, including website design and development, Google Business Profile optimisation, automated review request SMS, customer follow-up SMS for referrals, and monthly performance reporting.

3. Client Responsibilities

To allow us to deliver our services effectively, you agree to provide accurate and up-to-date information about your business, respond to our communications within a reasonable timeframe, provide timely approval of work where required, not engage in any activity that would bring Flowpoint7 or your business into disrepute, and ensure you have the right to use any materials, logos or content you provide to us.

4. SMS Terms

By submitting your phone number via our website or any other means, you consent to receive SMS text messages from Flowpoint7 including appointment reminders, follow-ups, and service information.

• Opt out: Reply STOP at any time to unsubscribe from all SMS messages.
• Message frequency: Message frequency varies. You may receive periodic messages related to your enquiry or account.
• Message and data rates: Standard message and data rates may apply depending on your mobile carrier and plan. Flowpoint7 does not charge for sending or receiving SMS messages.
• Carrier liability: Mobile carriers are not liable for delayed or undelivered messages.
• Age restriction: You must be 18 years of age or older to opt in to SMS communications.
• Help: Reply HELP or contact team@flowpoint7.com for assistance.

5. CASL Compliance

All SMS messages sent on behalf of clients comply with Canada's Anti-Spam Legislation (CASL). Clients confirm they have obtained appropriate consent from their customers to receive SMS messages. All messages include a clear opt-out option — recipients can reply STOP at any time. We never sell or share phone numbers with third parties.

6. Payment

Services are billed monthly in Canadian Dollars (CAD). Payment is due at the start of each billing period. If a payment fails, we will notify you and allow 7 days to update your payment details before services are suspended.

7. Refund Policy

All payments are non-refundable. If you cancel mid-month, no refund will be issued for the remaining days in that billing period. You will retain access to services until the end of the paid period if choosing end-of-billing cancellation.

8. Cancellation

No long-term contracts — cancel any time with no penalty. Upon cancellation you have two options. Immediate cancellation — we stop all services straight away upon request and no further charges will be made. End of billing period — services continue until the end of your current monthly subscription, after which everything stops automatically and no further charges are made.

9. Intellectual Property

Upon receipt of full payment, Flowpoint7 retains ownership of all deliverables created on your behalf, including your website, written content, automations, and any digital assets. Your website will remain live and fully operational for as long as your subscription is active. Upon cancellation, your website and all associated services will be taken offline. You will not receive the source code, files, or any transferable assets. You grant us permission to reference you as a client and use anonymised results in our marketing materials, unless you request otherwise.

10. Results Disclaimer

We work hard to get great results for every client but cannot guarantee specific outcomes such as search rankings, number of leads or revenue increases. Results depend on many factors outside our control including market conditions, competition and changes to Google's algorithms.

11. Limitation of Liability

To the fullest extent permitted by law, Flowpoint7 shall not be liable for any indirect losses, loss of revenue, or third-party service outages outside of our control. Our total liability shall not exceed the total fees paid by you in the three months preceding any claim.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, without limiting your rights under applicable local law.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of any significant changes by posting the updated Terms on our website. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.
